>> since both parties are talking about tax reform. maybe that is one point to start with since they believe in tax reform and bring in additional tax revenue. why do we have to accept that lame duck will not change anything. why do we change that? >> brian: 84 new people in the house and they feel like three weeks and the president goes to burma. >> steve: they will pass a band aid in the lame duck and then the new congress will have to fix it. mitch mcconnell will head up the republican side and he's very clear about taxes. one issue i never have been conflicted about was taxings. i wasn't sent to congress to raise taxs and this election doesn't change my principles it is clear if the president of the united states want to get something done he has to do it with no new taxings.

custody. he forced a plane to make an emergency landing after going on a rant about terrorist mid flight. that jetblue pilot that you'll remember may be set free. that is former pilot clayton osborne during his meltdown on a flight in march. he was arrested when the plane touched down in texas. he was found not guilty of interfering with crew members by reason of insanity. today a judge will decide if he can go free or if he will be committed to a mental facility. lot going on in the air. secretary of state hillary clinton paying tribute to u.s. ambassador chris stevens yesterday. stevens and three other americans were killed in the attack on the u.s. consulate in libya. they received a common ground award for conflict resolution negotiation and peace building. she praised him for volunteering for dangerous work. >> chris stevens was an

inspiration to all who served with him and knew him during his life. he remains an inspiration now and i believe far into the future. >> alisyn: clinton said a formal investigation of the terrorist attack is underway and changes will be made. she has asked to testify -- she has been asked to testify before congress next week, but no word yet on whether she will actually show up there. we may soon see another member of the bush family in political office. reports say that george p. bush filed the paperwork required to run for state office in texas. it's not clear what office he plans to run for. he's the nephew of george w. bush and the son of ex-florida governor jeb bush. those are your headlines. >> brian: he already served in the military. >> steve: it's impresssive. >> brian: as mentioned before the victims of hurricane sandy facing more dire situations bit day. it's been over a week. in new york, gas rationing

begins today and yesterday this was the scene without gas rationing. drivers with license plates ending in an odd number or letter will be able to fill up. chris christie had this idea last week. where were you, andrew who? now you have to wait for this week? next week, those with even numbers can get gas. in new jersey, those forced from their homes have been relocate to do a tent city in monmouth racetrack. what's it called, micro city? >> that's what they're calling it. we have here 20 sents being used to house about 200 evacuees. a significantly higher number of utility workers, law enforcement, even national guardsmen. incredible sight just went by here. it seems to have stopped for the moment. but off in the distance, perhaps you can see some of the utility trucks n. this parking lot, there are hundreds of utility trucks. look at the license plates, they're from all around country,

alabama, illinois, nebraska, texas, ohio, on and on and on, hundreds of trucks. they are here to help restore power to the area in the new jersey area that do not have electricity. there is really a small army living behind me in this tent city. as you also mentioned, there are a number of evacuees, 200 of them are also here. the conditions perhaps a little rough, but better than what their homes might be. they have a place to sleep. they have bathrooms. they have showers and also have kitchens and there goes one of the utility trucks i was just talking about. not entirely clear how long they are going to be here. but they're also getting three hot meals a day, catering company on long island is providing them. that's through the courtesy of fema. summing things up, one of the organizers said what you see here is truly a community that is coming together. the conditions here, cold this morning, but looks like progress is being made.

story, and you talked to the author about it, says we're looking to set up direct talks with iran as soon as possible. we're asking for the supreme leader. >> alisyn: she's supposedly valerie jarrett, if you believe the israeli news reports. she's supposedly laying the ground work for these one on one direct talks. it's interesting, you brought up october surprise in relation to the drone. but a lot of people thought this could have been the october surprise. the war had predicted that there was going to be an announcement that suddenly there was an agreement with iran, so it was hard to know if this is connected and that valerie jarrett was trying to lay the groundwork for iran to suddenly announce it was abandoning its nuclear program. >> steve: maybe that's one of the reasons why we didn't hear about it five days before the election because she was working hyped the scenes with the iranians. we should point out the iranians and the white house say there is nothing to this story. however, so many people over there are talking about the fact that it has happened. there could be something to it. keep in mind, we have not had direct talks as this would be

from cuts and voters reject the idea that bringing down the federal budget deficit is an overriding priority. >> did you listen carefully to that? tax the rich, keep spending on entitlements. no reform. and don't worry about the debt. >> brian: the unions firmly believe they put president obama over the top. >> well, maybe they did. i don't know about that. but that's the chief union guy repeating the policy that will be followed in the second obama term. look at greece, greece is in chaos at the moment because they let their debt run and run and run. riots in the streets, unpayable debt. they're look for another two years before they start paying it back. that's another 30, maybe 50 billion euros of extra debt. >> brian: we should put our extra money into tear gas? >> steve: tear gas makers. >> brian: every time i see a greece shot, there is tear gas. >> everybody asks, what are you going to do with your money in a second term? i don't have a decent answer for

about it. a lot of people have been frustrated. you're seeing how long this line extends up 39th street here in queens. this has been the case all over the place all over the tri-state. new jersey started it earlier this week. now it's new york's turn. we'll see how it goes. the lines have been moving. this one has moved, but it is still significantly long. >> steve: it is a mess. antoine, thank you very much. over to ali and the other brian. >> brian: speaking of sandy, thousands of residents on long island, new york have been battling the power company. >> alisyn: long island power company decided that after sandy hit, they would require all homes and businesses in the area to have new inspections done before they could restore any electrical services. >> brian: this is what i was doing yesterday. >> alisyn: well, yesterday after increased pressure, they decided to scrap that evaluation plan. they then announced many in the

area would be without power through thanksgiving, if you can believe it. so here to fill us in is the town supervisor. tom. do you have any idea how many people on long island are still without power? >> close to 300,000 still without power. in our town, 12,800. >> brian: why? >> that's a good question. the towns have done everything they were supposed to. we did these inspections. we made sure the homes in our estimation were as safe as possible. and then the rules were changed in the middle of the game. >> alisyn: do you have any sense of with lipa, they've become the bad guy and for good reason. we're day 11 into this. were they woefully ill prepared before hand? was this such a big storm that nobody could ever have been prepared? >> you could have been prepared. the lessons we learned after hurricane katrina in my time at the white house and the homeland security staff is that you preposition yourself in the area before the zone is impacted. you do the precoordination, prestage assets, video

teleconferencing from the white house with alt federal agencies, putting those resources in place before the storm hits. >> brian: they are out of poles! they don't have enough poles to replace the broken poles. we don't have water or gas. they don't have a plan, they don't have a communications apparatus. i don't understand why your governor is basically hostage to these people! he's acting like an outraged resident where he should be taking action demanding something to change! there are faceless bureaucracy, monopoly that operates without incentives. no kidding. they are before and now after and during. >> some of those precoordination meetings with the national government would be with the emergency operations centers. getting an idea from the state what resources do you have? >> brian: did that take place? >> i have no idea. >> brian: it didn't take place at your level? >> it certainly did not. >> alisyn: one of the most maddening things for people about this, and i can speak to this because i'm in connecticut, we were without power for seven

days. the one comfort was you could call connecticut light and power, which people were also complain being their response. but you could call them at any time and a human being would answer. that was comforting. lipa is not doing that. >> our residents stopped calling ilpa. they're calling their towns or local officials. >> brian: they handed me a card yesterday and said be home in the inspection. i got this thing called a job and we don't have any power. no one is at their house 'cause we don't want to die. they said, don't worry, call this number. busy. this number doesn't dig a -- it's not supposed to be busy. you served in the navy. you've worked in war zones in third world countries. you're saying right now this is like a third world country. >> we have the same mass failure of infrastructure that you would see in places that have been ravaged by natural disaster or manmade disaster. like a war zone. you have people who won't leave their homes and rightly so. this is america. this is new york. they shouldn't have to leave their homes. but they have no power. they have no heat.

term, the encroaching fiscal cliff. john boehner has drawn a line in the sand about how republicans will approach negotiations over the next seven weeks or so and while he is okay with increased revenue, he says it needs to come from tax reform. not tax rate increases. >> raising taxes on small business people is the wrong prescription given where our economy is. >> is it on the table to talk about it? >> i made clear yesterday that raising tax rates is unacceptable. frankly, it couldn't even pass the house. putting increased revenues on the table, but through reforming our tax code. and i would do that if the president were serious about solving our spending problem and trying to secure our entitlement program. >> furthermore, speaker doesn't want to rush the tax reform and says there isn't enough time in this lame duck session of

congress to do things the right way and he thinks the fiscal cliff can be avoided by the end of the year, but real reform should wait. across the capitol, democratic majority leader harry reid made his position as well in the senate that the american people reelected president obama knowing he supports higher tax rates for the rich, so he thinks that's where negotiations should start. >> the president campaigned around the country saying we know what is wrong with the fiscal problem. we need revenue. that was the issue. >> there is a lot to talk about when it comes to the way around the fiscal cliff. the way that today's statement in the east room is being billed, that is all the president will focus on today. back to you in new york. >> steve: peter doocy live in the capitol with a preview of what the president will say at 1:05. meanwhile u got to wonder how many members of the president's first term cabinet is going to stick around. we know hillary clinton is

boy found in his parents' couch and then the kid took the money and spent it on candy. it turns out it was his parents' life savings. there is nothing funny about it. a message, keep your money out of the couch. brian? >> brian: colorado and washington becoming the first states to legalize recreational marijuana this week. will making pot legal really help ease the courts to focus on bigger crimes? here to debate it, criminal defense attorney, and president of the national narcotics officers association coalition, ron brooks. will this alleviate some of the backed up court system? >> i don't know how much the court system is backed up. i will just tell you in the state of new york, it is in part of the law that if it's your first offense, you have no criminal record and you get caught with a small amount of marijuana, by statute, it's automatically dismissed. you still have to go to the

judge. you stand before the judge. this is your first arrest? yes. recreational use, yes, you're done. i don't think that's jamming up the court system right now. at least not in the state of new york. >> brian: i guess the benefit would be additional taxes. is there a down side to legalizing pot, ron brooks? >> a couple of things. first of all, it sends a bad message to our kids. the studies are clear that the number one reason kids choose not to use marijuana is because it's illegal. on the tax issue in california, we get about $19.9 billion in -- we spend $19.9 billion on our two legal drugs, alcohol and tobacco for public safety and health care. we get 1.5 billion back in tax revenue. clearly we're going to spend a lot more on public safety, health care, lost opportunities than we're going to get in revenue back. >> brian: 65% of the kids who have drug problems are saying it's because of pot, arthur. there could be a real down side

to looking at the short side and that's additional tax revenue. >> i don't think people voted for this. 56% of the electorate in colorado voted for this. i don't think they did because of the tax benefit. i think they did it -- look, it's going to be an experiment. it's going to say, hey, is this really a gateway drug? let's see what happens over a year. the rise of cocaine going to go up? is crime to go to go up or is everything going to stay the same within the law? people are smart. if things change drastically in their community, they'll change the law. >> brian: ron, do we need this laboratory? >> we don't need this laboratory. we tried it in alaska 78 to 90. 57% increase in teen marijuana use across the state of alaska, compared to the rest of the united states. we already got in 15 of our states, more drug drivers, marijuana drivers than we have alcohol drivers. it derails kids.

it's an addicting drug. the studies are all clearly in. it can trigger schizophrenia. it triggers bipolar disease. it is just hard on kids who have a hard enough time. >> the federal government has the ability to shut this down if they want to. eric holder -- marijuana is not legal federally. there is no such thing as medical marijuana in the federal court. so they can defend -- someone can go into california where they have medical marijuana and go to colorado and they can shut it down if they choose to use their resources for that as opposed to other things. >> brian: i can see very little upside to this trend continuing. ron brooks thanks so much for your work. arthur, always great. >> thank you. >> brian: arthur, don't touch my stuff. straight ahead, think pink, the dancing hospital workers who started a world wide contest back with an update next [ male announcer ] in blind taste tests, even ragu users chose prego.

that man was taken into custody. and democratic senate majority leader harry reid is confident america will not hit the debt ceiling. >> we're not going to be held subject to something that was done as a matter of fact in all previous administrations. it has to be raised, we'll raise it. >> alisyn: if congress raises the debt ceiling another $2.4 trillion, that would bring the legal limit on the government's debt to $18.79 trillion. the election was called tuesday night. but it's friday. we still don't know who won florida's 29 electoral votes. workers are still counting thousands of absentee ballots in miami-dade county. more than 31,000 ballots were tallied yesterday. and two other counties are still counting. as of yesterday afternoon, president obama had 49.9% of the statewide vote while mitt romney had 49.24%.

with even numbers on their plates can fill up. >> steve: in other words, whatever day it is on the calendar, if that's an odd day, and you have an odd number on your plate. >> brian: like today. new jersey -- people forced from their homes in new jersey have been forced to relocate to a tent city where we have david lee miller set up to talk about this micro city. david? >> that's right. one of the incredible things about this city is that it also houses utility workers. take a look to my right. look at the caravan of cars and trucks going by. these are utility trucks that are from all around the country. monmouth park housing those displaced, but also about 1,000 or so utility workers from all around the united states. one of them is with me right now. anthony, you've been using this as a staging facility, living in a hotel, you're from north carolina. tell me, how is it going? how soon 'til the lights get back on for people in new jersey? >> i can't tell you how long this is going to take the lights

back on, but working as hard as we can doing what we can every day, everybody out here is doing it as safe as possible and quick as possible. >> what's it like out there for you? how many hours a day you working? >> 17 hours a day. >> when you see people, are they angry? are they happy to see you? what's the frustration level? >> most people are real happy to see us when we get on their streets and start putting lines back in the air. some are frustrated. that's understandable. we can't do but so much at a time. we do what we can while we can. >> how are people treating you in new jersey? how is the food? >> oh, man, it's excellent. they feed us real good back there at this tent. they're taking care of us. >> i know you have to get back to work. from north carolina, thank you for joining us. guys, one of the things worth noting is that post-election, we've got an army here of utility workers from dozens of states, worth noting red and

blue. back to you. >> steve: all right. if you see the guys from georgia power, thank them for turning on our electricity. geraldo rivera was in the dark figuratively. >> maybe in a lot of different ways. but i was restored by a team from missouri -- restored the power and a team from wisconsin cut the trees. >> steve: it's great they traveled to far. the storm response has been horrible. >> it's been mixed. i was in staten island overt weekend and what i saw was the heart of the entire recovery effort is the volunteer effort. it's the private effort. even the red cross it seemed took a back seat to a kind of an ad hoc, spontaneous outpouring of compassion by our -- >> steve: they had to pick up the pace because fema just stunk. >> i think even in terms of fema also, i think the jury is out, steve. honestly, i think the tent city is a great idea. >> steve: they didn't have water until five, six days after the event. >> brian: you're right. fema people, hired contractors, they were there. i give you that.

and they were organized and they have follow-up phone calls. but what they didn't do is preposition gas, water, trucks, generators, anything! as if this whole storm shocked them. >> i totally -- like you, itch a lot of family living south of sunrise highway on long island. my niece, newly married, she lost her house and they're a wonderful young couple. they just had a new baby and they had all the baby memorabilia there. it's heart breaking. but fema was there and they've already signed up and they should do okay. my nephew, bobby reed and his wife, michelle, and their family in islip devastated with damage. but again, it looks as if the government agencies are doing the right thing. i really do believe that if there is a goat in this, it is the long island power authority which has not been at all coordinated in its response. >> brian: they've been smug, condescending and giving out

disinformation. 11 days, no answer, no interest in getting answers. last night, extraordinarily, both county executives that make up this huge island say we're calling on the military to take over. >> well, i think -- i always go back to the military. they're the most organized u.s. government agency, the most effective government agency. it's sad but true that they would do a much more effective job. but i also have to point out that governor christie seems to have been more hands on in terms of you better get there and get that going than governor cuomo, who is a person highly regarded in new york state, but seems a bit more angry from a distance rather than there, you know, come on, guys,. >> alisyn: just to remind everybody of what a human crisis this is and how people are suffering, let's listen to somebody on staten island. >> unacceptable. totally unacceptable. my father and people on my block, they're retired firemen or active duty firemen. we don't know who the president

is. we can't find out. we have to ask people. we have no idea where the help is. we have no idea where the free food is. we have no idea where anybody is. we can't contact any building departments, any insurance companies. we're not getting any help. it's unfair. >> steve: geraldo, president bush was slapped for katrina and no doubt mistakes were made. you were there. this president completely got a pass on this after his photo op. >> i think that there is definitely a difference in the way the press viewed the presidential response, no doubt about it. i just have to share one quick acin the case dote from new orleans. i remember being at the convention center where there were dead bodies, as you recall, it was a horrible situation. fema arrived and they had brand-new black t-shirts with fema and police written on them and the fema guys come in and look very importantly and one of the press aides was looking to get the boss on my air and then he says to me, do you have any idea where the super bowl is? i said turn around, it's right there -- super dome. if you didn't know where the

super dome, and it was within sight, it was so clear that the guy was clueless. i think in this case, they were very sensitive to doing the best they could early on so they would avoid some of that criticism, particularly -- we would hope they would be more sincere than the election, but it's possible there was a political motivation. but they seemed to be more visibly trying and more visibly organized, although obviously there are pockets with its -- >> brian: it was a charade. because of the way he handled the storm, they've been had if they voted for the president because of the way he handled it. >> if 50 people lose power and are the are restored, it's still a -- >> brian: i'm talk 30:00:00. >> our hearts go out to you. >> brian: forget about me. 300,000 nine days later. >> alisyn: let's talk about something that happened before the election. one of our drones, plane over international waters, 16 miles off the coast of iran, was shot

at by iranian forces. we didn't learn about it until this week. >> steve: after the election. >> alisyn: after the election. your thoughts on whether they sat on that information? >> it's a different issue. let me start from the beginning. if two modern fighter jets fire at an unarmed drone and they want to hit it, they hit it. it is impossible to miss. they go so slow, they're big, fat, ugly targets that anyone could shoot down. you could go by with a 45 and take it down. they missed intentionally. that doesn't diminish the fact that it is still with a shot at american asset in international waters, and it is officially an act of war. i agree with that. jump cut to the question of why we didn't know about it initially? jennifer griffin reports that it was a classified mission. that's one of the reasons they gave for not revealing it. but i think it's pretty clear, like the response to the storm, that there is a political

component to this and what happens if this news breaks before the election? then the president is then pressured -- what are you going to do about it and he had his plate full. i think there was a political calculus. we can deal with this later in a couple of days, you know, a week from now. like the benghazi situation, let's postpone it 'til after the election. i've got enough to worry about. >> steve: you know what? reportedly according to the white house, they told top republicans and democrats in our legislature about it. but mitt romney was getting classified briefings. he should have been told. he was not. >> he was not. i'm curious about what briefing governor romney had about benghazi. i still go back to the biggest imponderable in the presidential race, why the governor did not bring benghazi up in the second and third debate. you wonder what kind of briefing he had then that perhaps dissuaded him from bringing it up. in the case of the drones, you know, i believe there is a political component.

i am fascinated also by these rumors of one on one, face-to-face negotiations between the united states and iran. i had no idea that valerie jarrett, one of the prime advisors to the president of the united states, was actually born in iran. >> steve: she was. >> i had no idea. >> steve: her dad worked at a hospital there. >> she was there until the anal of five and speaks farsi. i don't know for a fact. >> steve: look at all the stuff you got to talk about this weekend. >> brian: and you owe it all to us. >> steve: we set the table. >> it's so nice to have my seatbelt fastened. i love you all. >> steve: thank you very much. straight ahead, a city council race ends in a tie. why? because one candidate's wife didn't vote. oh, it's true. >> great pillow talk there. >> alisyn: president obama can thank big labor for his big win on tuesday. what does he now owe the unions in return? the answer may give some insight in his second term agenda.

taxpayers blind," mallory factor. nice to see you again. >> good to see you. >> alisyn: so that was richard trumka taking a victory lap, basically saying they turned out lots of support for the president. the president wouldn't have won without him. is he overstating the case? >> no. he's understating the case. it is unbelievable the amount of resources that the unions put out. they gave him a half a billion dollars and they had 400,000 people out on the streets for him, more than 400,000 actually. and they really spent a lot of time in the seven battle ground states. obama would not have won. nevada, wisconsin, ohio, without big labor. richard trumka was right. he owes him big time and this union label president will pay off. >> alisyn: okay. so as we know, politics is a game of tit for tat. you say that the president owes them big time. so how will he repay them?

>> first thing you're going to be seeing is the employee prechoice act, card check. it's doing away with secret ballot elections. they desperately want to be able to just force people to sign up by standing over them and having them sign a card. second thing you're going to see is health care, obamacare be implemented, which will give enormous amounts of new members to the unions. you will see he millions of new members because of obamacare because obamacare will be a program that -- where money will be coming from the states. third thing is more insourcing, which is basically not letting the federal government go out and let independent people do some of the jobs more inexpensively. they're going to bring them in house in the federal government which means more union members. >> alisyn: obviously compromise is the word of the day since the election. but with the unions expecting something, how hard will it be for the president to compromise?

>> first of all, there is no compromising with the unions. he owes them big time. it's going to pay off. he's a union labor president. the real thing they want is a little tiny section of the act called section 14 b. if they can get a few words taken out of that act, there will be no more right to work state that. is their ultimate goal, getting rid of right to work states and having forced unionism throughout the entire country. they're going to be working for that and he will sign that bill if they can get it passed. >> alisyn: all right. we wl wait to see if that happens. mallory factor, thanks so much for coming with your insight. >> thanks. >> alisyn: senators allowed to look at the documents on the libya attack. but they only have two days. it's the two days that they're out of town. what's going on with that timing? judge jeanine it here with her theory. check out this unlikely pair who refuse to leave each other's side. there is a lot more to this love

them, but you can't take them home with you. we're going to let you look at them on a day when we know you're not in town. we're going to let your staffers look at them. this is a continuation of what's gone on for the past seven weeks with respect to the september 11 attack in benghazi. now that the election is over, everyone is hoping that we'll start to get answers. you've got house intel, senate intel, house foreign affairs and senate foreign relations. the bottom line is, most of these hearings are going to be closed. we're not going to hear, we don't believe, from hillary clinton. she's sending kennedy in. it seems like more of the same. but you know what? let's give them the benefit of the doubt. there are closed doors hearings as well as this stuff that they can see only today now. we'll find out if the whistle blowers are going to come up and tell us what happened. >> steve: that's the key. hillary clinton, susan rice, they're politicians. they're going to have political answers. i want to hear from the people who were actually there that night. >> i will have on my show tomorrow night, a member of the

house foreign affairs and intelligence. what they're telling us, along with chaffetz and other congress people is that it's the whistle blowers who are coming forward. by the way, when we talk about these cables, a lot of them have been leaked already. and we have a real sense of what's gone on. that there was a request for protection. it was denied. it was reduced. and then the lie about the protests and the video. >> brian: right. i cannot wait for david petraeus. he runs the c.i.a. right now. he's going to show up because the intelligence community has been thrown under the bus. they have a way of getting their way issue their point of view out in a diplomatic way and saying, we said what we said. we knew right away. and then let the facts be the facts. >> here is the issue, you've got intel and then you've got susan rice on the shows saying it was a video and it was a piece of protest -- peaceful protest where they brought rpg's. that's like bringing a chain saw to a picnic to cut a hamburger. and at the end of the day, we have to find out who told susan

thailand, he is going to speaking about the fiscal cliff and set the tone, we think, of a bipartisanship, a reaching out to say we have to, together, avoid the fiscal cliff. now i got to go somewhere else. >> alisyn: if this is going to be bipartisan and they are going to compromise, then he'll have to somehow moderate his position on raising taxes on everyone who -- every family who makes $250,000 or above. that was the line in the sand that he drew. the republicans drew their own line in the sand. so they have to somehow come together because john boehner and his most recent interview this week said that he still believes that tax hikes are unacceptable. listen. >> raising taxes on small business people is the wrong prescription given where our economy is. >> is it on the table to talk about it? >> i made clear yesterday that raising tax rates is unacceptable. frankly, it couldn't even pass the house. putting increased revenues on the table, but through reforming

our tax code. i would do that if the president were serious about solving our spending problem and trying to secure our entitlement program. >> brian: we have to have a short-term fix 'cause there is no way you can reform the tax code with a lame duck congress in a short time. >> steve: you got to say, let's put a band-aid on it for right now, but coming up in the next term, we're going to have to sit down and do something about taxes. and seriously about debt as well. mitch mcconnell has certainly got john boehner's back. he agrees. he says, quote, one issue i've never been conflicted about is taxes. i wasn't sent to washington to raise anybody's taxes to pay for more wasteful spending. and this election doesn't change my principles. here is something that the president and the folks in the white house have to think about. since they are intent on raising taxes, the congressional budget office says hold the phone. not so fast because if the taxes all get hiked up as they're

going to at the end of the year unless there is some sort of a change and they come to an agreement, there would wind up being a recession in this country one year from right now, unemployment would be above 9% and the economy, they say, would contract by about a half a percent when it comes to the gdp. those are two very sobering numbers. in other words, if they can figure a way to do something about the debt problem and also about stuff we were just talking about right there, you know, as we got up to the cliff, we'll have a way down. but you've got to address it directly. >> brian: let's go to wall street. >> alisyn: as you know, wall street is reacting to the approaching fiscal cliff. markets have plunged for two days in a row. what's next? >> brian: sandra smith joins us from the floor of the stock exchange where things have been going down, down, down. sandra, what do we expect today? >> stock index futures are already down pointing to another lower open on wall street. this is after two days of

post-election selloff over a-day period since the elections, the dow jones industrial average down 434 points. that's a drop of more than 3%. there is concern that if we have another selloff today, that we may see the stock market dip into negative territory for the year. the dow jones industrial average after the last two-day selloff is now up to 5%. so there is a threat of dropping into negative territory. already talking to traders on the floor ahead of the president speaking later this afternoon. there is no sugar coating it. the traders are concerned. they're concerned about the fiscal cliff. they're concerned about europe. fitch, ratings company this morning threatening to downgrade spain. that's in play. corporate earnings don't look great. we're getting warnings from retailers about the holiday shopping season. they're forecasting a slower season this year than last year. all of those concerns are playing out in the stock market right now, guys. so you better believe it. these traders are going to be listening to what the president says this afternoon, what his

plans are to get this economy going again. what he says about the fiscal cliff, the tone that he sets, they're going to be watching this very closely. guys, indeed we're looking at a lower open, again this morning on wall street. back to you. >> steve: all right. sandra, live at wall street. we thank you very much. you'll be able to see the president's comments today live from the east room at 1:05 eastern time. new york city will begin rationing gas for this first time since jimmy carter was president. it's in response to the gas crisis at thank shut down hundreds of stations and forced drivers to wait in line for hours. >> alisyn: antoine lewis is live in queens with more on all this. what are you seeing, antoine? >> you have to see this picture to kind of at this time putt it in perspective. we're at 39th street and northern boulevard. this mini van that you're seeing right here is outside of the line. some of these people have been in line trying to get gas since last night. that mini van was actually trying to cut the line, to try to get into this gas station on

the corner because they have fuel. but you also see that nypd officer, because police are here making sure those that are in line can get their gas and those who are not are breaking the line, you will not be able to get in. this is the case at all of the gas pumps and gas stations in new york city because gas rationing went into effect at 6:00 o'clock this morning. what that means is that if your license plate ends in an odd number on an odd day like today, you can go get gas from a gas station that has fuel. if it's an even number or even plate, then it's an even day. that's going to be the case. it will be like that for a while. we haven't heard any direction from head city hall how long it will be. but that's the case now and at least for the next week, we are guessing that's how it's going to be. the situations like that have been popping up all over the place. not fistcuffs here. >> brian: are you on the sidewalk or the street? >> on the sidewalk. >> steve: stay there. >> long island city.

show trial. they withhold it. four years later, there is still no justice. they were ready to plead guilty for it. that alone is bad enough. then you look at being in contempt of congress and all -- if he didn't know about fast and furious, that alone is enough to be fired. and if he did, then it's something more serious than being fired at stake here. then we hear napolitano may be the replacement? i tell you what, steve, any republican senator that supports napolitano to replace this guy after all the wrongs she's done and the imcompetence needs to be targeted and defeated in the next election. she should not be the replacement. >> steve: it's interesting you should mention that about janet napolitano, congressman, because i was reading in a couple of main stream media newspapers today that she's well regarded on capitol hill where you work and she's not held in good regard from you. >> i mean, look at it. this summer when i asked her, she wasn't even aware that there

was a member of a terrorist organization in the white house. she educated herself. she has given classified access to people that were not properly vetted, at least one we know of. i was told by the director of dps here that her chief of staff said that very night that napolitano had been briefed on a person she gave classified access to and the next morning, she said she knew nothing about it. either she's got a liar for a chief or she's lying. i mean, there are so many things involved. oh, in march of 2009, she's out there saying, we're going after any gun dealer who sells guns that end up in mexico. either she's completely incompetent or she was complicit with the justice department in getting those guns to mexico. there is plenty -- i mean, she's completely interwoven with the justice department's problems and she has no business being there. she may know what's going on over there, but that's not a

>> brian: yesterday the pentagon confirming just days before the election, iranian jets tried twice to shoot down an unmanned u.s. drone, unmanned and unarmed u.s. drone over international waters and failed. the news came out yesterday. many this morning are asking, why now? are we finding out about it. joining us is fox news strategic analyst and author, lieutenant colonel ralph peters. did they try and shoot down this unarmed drone or just send use message? >> they absolutely wanted to shoot it down. the order would have come from the very highest levels and the iranians wouldn't have screwed

around. a unmanned aircraft might have been different. they figured they could knock it down and get away with it. it was embarrassing for the iranians because they chose an interesting aircraft, an old russian aircraft, knockoff of our tank killer, clearly -- pilots don't get a lot of air to air training. and it looks like they didn't calibrate their guns properly. so they had old aircraft, bad pilots, uncalibrated guns and they just plain missed and i'm sure a lot of iranians were chewed out after that one. of course, we didn't know about it because the white house, as usual, covered it up. brian, this white house would have tried to cover up pearl harbor. >> brian: this is technically an act of war, lieutenant colonel. and what do you think our right response should be? >> it is technically an act of war, although the administration will play that down. our response should be a measured response at this point. we should set autopsien aerial
